AZ Backyard Party Rentals - Updated Rental Agreement (2026)

By booking with AZ Backyard Party Rentals (AZBPR), the client agrees to, understands, and accepts all of the following updated terms and conditions:

CUSTOMER PROFILE & ACCOUNT CREATION

All customers are encouraged to create an online account to simplify booking, payment tracking, and order management. The following information is required to complete a customer profile:

  • Full Legal Name
  • Valid Email Address
  • Phone Number
  • Event Date & Location (if applicable)

By creating an account, the customer agrees to maintain accurate, up-to-date information and acknowledges that their profile data will be used to manage all rentals, contracts, and communications. Profiles are protected under our data privacy and usage policy.

RENTAL PERIOD, EXTENSIONS & EQUIPMENT USE

  • The standard rental period is 24 hours, which covers two calendar days (e.g., Saturday to Sunday). This period is now open-ended, allowing flexible return within your assigned timeframe.
  • Rental pickups and returns are available between 10 AM – 5 PM.
  • If items are not returned or made available for pickup within 24 hours, the client will be charged an additional late fee of $50 per calendar day, or 50% of the daily rate, whichever is greater.

  • Requests to extend rental time must be made before the return date. Late or unapproved extensions will automatically incur late fees.
  • All equipment must be used as intended and handled with care. Misuse, neglect, or operation contrary to manufacturer or AZBPR safety guidelines will result in liability for damages.
  • The client assumes full responsibility for all equipment while in their possession, including during transport, setup, and use.
  • Equipment must not be altered, relocated, or used for purposes other than those intended. Clients are responsible for preventing theft, loss, and damage due to weather, negligence, or misuse.

EQUIPMENT CONDITION & DAMAGE REPORTING 

  • All equipment is cleaned, inspected, and photographed before release. By picking up or accepting delivery of your order, you confirm you received the items in clean, working condition.
  • If you notice any pre-existing damage, missing parts, or cleanliness issues, you must report them to AZBPR within ONE (1) HOUR of pickup (or of delivery) by text to (602) 492-1852 (text only) or email to [email protected], and include a clear photo of the issue.
  • If no issue is reported within that one-hour window, all items are deemed accepted in good, clean, and undamaged condition. Any damage, excessive soiling, or missing parts identified at return inspection will then be presumed to have occurred during your rental period and charged accordingly.
  • You are responsible for the equipment from pickup/delivery until it is returned and inspected by AZBPR.

REQUIRED PICKUP & DROP-OFF INSPECTION FORM 

  • Completing our short pickup/drop-off inspection form is a required part of every rental. You will be asked to complete it at the storage unit at both pickup and drop-off. The form is your opportunity to document the condition of items and note any concerns.
  • Completing the form protects you: it is where any pre-existing issue should be recorded. If the form is not completed, AZBPR's pre-release and post-return inspection photos will serve as the record of condition, and the customer accepts that record.

AUTHORIZED PICKUP & DROP-OFF BY SOMEONE ELSE 

  • You may send someone else to collect or return your order. AZBPR can issue that person their own check-in link, which shows them the storage unit, the gate code and the lockbox code. Anyone holding that link can open the unit.
  • Sending someone does not transfer the rental. The order stays in your name and you remain fully responsible for the equipment — for loss, damage, excessive cleaning, late return, and for anything removed from the unit that is not on your order — exactly as if you had collected it yourself. Any resulting charges are applied to your security deposit and payment method on file under the Deposit & Payment Terms and Damage, Loss & Cleaning Fees sections.
  • The person you send acts on your behalf. Their check-in, their inspection of the items, and their acceptance of the order count as yours. The one-hour reporting window in Equipment Condition & Damage Reporting starts when they pick up, not when you hear from them.
  • You are responsible for who receives the link and for their conduct at the facility, including everything in Pickup Guidelines & Storage Site Policy below. A link cannot be cancelled once it is sent — if it reaches the wrong person, text us immediately at (602) 492-1852 (text only) and we will change the codes.
  • Guest links expire with your rental. AZBPR may decline to release equipment to anyone without a valid link, and may require the order to be collected by the customer named on it.

LOCATION CHECK-IN 

  • The check-in page asks your device for your location so we can confirm you are at the storage unit. Your browser will ask permission first, and you may decline.
  • Your coordinates are never sent to AZBPR and are not stored. The comparison happens on your own device. What reaches us is whether the check-in was confirmed at the unit and, when it was, how far the reading placed you from it.
  • Declining, or a reading we cannot confirm, does not prevent you checking in. The check-in is recorded as unverified and your pickup or return proceeds normally.
  • Your check-in record — the timestamps, whether the location was confirmed, and any photos or notes you add — forms part of the inspection record described in Dispute Evidence & Inspection Records below.
  • This applies equally to anyone you authorize to pick up or drop off on your behalf. Please tell them before you send the link.

QUOTE-ONLY & DELIVERY-ONLY ITEMS, PRICING ERRORS & ORDER INTEGRITY 

  • Some items are marked "Quote Only" in their product description. These items have no online price and require a custom quote from AZBPR before they can be rented. If a Quote-Only item is added to an online order — including any item that appears at $0.00 or an obviously incorrect price — that line is not a valid booking. AZBPR will contact you to provide a proper quote or, if the order cannot be corrected, may cancel the affected item or order at no penalty to AZBPR.
  • Some items are available for delivery only and are marked as such. A delivery-only item added to a pickup order is not a valid booking; AZBPR will offer to add delivery or substitute an item, and may cancel the affected line if neither is accepted.
  • Placing an order does not guarantee a price that is clearly erroneous, nor does it guarantee a Quote-Only item at $0. AZBPR reserves the right to decline or cancel any order that attempts to bypass posted pricing, fulfillment rules, or product descriptions. Repeated or bad-faith attempts may result in refusal of future service.
  • Delivery pricing is based on distance from our Chandler location. Your delivery questionnaire may add a surcharge for access or timing needs beyond a standard drop-off — we always confirm it with you before charging.
  • The delivery figure calculated at checkout reflects distance only. It cannot account for the conditions at your address — for example a path of rock, gravel or grass, stairs or a long carry, or a request for an exact arrival time — which is why we ask you to complete the delivery questionnaire before your event.
  • No surcharge is ever applied without confirming it with you first. If you decline it, AZBPR will deliver to the standard drop point (the driveway or the side of the house near the gate) at the quoted price, and final placement is the customer's responsibility.

DEPOSIT & PAYMENT TERMS 

  • $50 refundable security deposit is required for most rentals and is refunded within 5–10 business days following return inspection. By placing an order, you authorize AZBPR to deduct from the deposit any documented cleaning, damage, late-return, or replacement charges. If those charges exceed the deposit, you authorize AZBPR to charge the remaining balance to the payment method on file. You will receive an itemized summary of any charges applied.
  • The deposit amount is subject to change, reduction, or waiver at the discretion of AZBPR, based on customer rental history, order size, or trustworthiness.
  • Full payment plus the $50 refundable security deposit is due to reserve your date. Your date and equipment are not held until both are paid.
  • For orders of $500 or more, a partial payment to reserve may be arranged on request. The reserve amount and the balance due date are stated on your order, and the balance is due no later than 10 days before the event date.
  • A reserve payment is non-refundable and is applied against any cancellation charge that becomes due.
  • A partial payment to reserve is not available within 14 days of the event date.
  • If the balance is not received by its due date, AZBPR may cancel the order and retain the reserve payment.
  • Partial-payment arrangements are set up manually. Online checkout collects the full amount.
  • Accepted payment methods: Major credit/debit cards, PayPal, Apple Pay and Google Pay.

ORDER MODIFICATIONS

  • Order changes (quantity adjustments, substitutions, or additions) must be submitted at least 7 days before the event date.
  • Reductions made within 7 days of the event are non-refundable.
  • Additions are accepted up to 3 days before the event, subject to availability.
  • Once items are picked up or delivered, no modifications or refunds can be made.

CANCELLATION & REFUNDS

  • 14+ days before event: Refund minus 15% administrative fee.
  • 7–14 days before event: Forfeit 25% of total order.
  • Under 7 days: Forfeit 50% of total order.
  • Orders placed within 7 days of event: Non-refundable.
  • Weather-related cancellations: No refunds, but a non-transferable credit may be issued at AZBPR's discretion (valid 12 months).

WEATHER & OUTDOOR CONDITIONS 

  • Once equipment is in your care, you are responsible for protecting it from rain, wind, and harsh weather. Please keep equipment out of direct sunlight when possible and secure or cover items during unexpected weather. Damage caused by weather exposure, or by items left in unsafe conditions, may affect your security deposit.
  • For outdoor items affected by wind (such as umbrellas and tents): high winds can make these items unsafe. AZBPR may proactively contact you before your event if the forecast shows high winds, heavy rain, or a severe-weather warning, to discuss safe use or alternatives. You are responsible for discontinuing use of any item that becomes unsafe in windy or severe conditions.
  • Weather-related cancellations follow the Cancellation & Refunds section above.

DAMAGE, LOSS & CLEANING FEES

  • Normal wear — no charge. Light dust, ordinary handling marks, and natural fading from expected use are never charged.
  • Excessive cleaning — up to $25. An item that is still usable but returned significantly dirtier than expected (wet or muddy, food or drink residue, stains requiring re-washing, not wiped down) incurs a cleaning fee of up to $25, deducted from the security deposit.
  • Damage or loss — documented cost. An item that is not usable as-is, or is missing, is billed at the documented repair or replacement cost (replacement at full retail value plus tax and sourcing costs). The security deposit is applied first; any remaining balance is charged to the payment method on file. You will receive an itemized summary, with photographs on request.
  • AZBPR does not offer a damage waiver.

PICKUP GUIDELINES & STORAGE SITE POLICY

  • Clients must not damage or litter at the storage facility.
  • All rental items must be properly stacked and organized upon return.
  • Only retrieve items assigned to your order.
  • Do not leave items outside the storage unit — unreturned or misplaced items are considered lost.
  • Security monitoring is in place; tampering with security equipment is prohibited and will result in legal action.

DISPUTE EVIDENCE & INSPECTION RECORDS 

AZBPR documents the condition of all equipment with timestamped photos before release and after return. In the event of a dispute regarding the condition, cleanliness, or completeness of returned items, these inspection records — together with the customer's completed (or uncompleted) pickup/drop-off form — will serve as the controlling record.

HOLD HARMLESS & INDEMNITY

Clients assume all responsibility for safe operation and agree to hold AZBPR harmless from claims, damages, or injuries resulting from misuse, negligence, or failure to follow safety instructions.

FORCE MAJEURE

AZBPR is not liable for delays or cancellations due to events beyond its control, including weather, power outages, accidents, or civil disturbances.

DEFAULT & LEGAL ACTION

  • Non-payment or failure to return items is a breach of contract.
  • AZBPR reserves the right to pursue legal remedies or collection efforts.
  • Disputes will be governed under Arizona law and resolved in the jurisdiction of AZBPR's business location.

PHOTO & MEDIA CONSENT

By booking with AZBPR, the client grants permission for AZBPR to use event photos/videos for marketing and promotional purposes, unless an opt-out request is made in writing.

FINAL AGREEMENT

By placing an order, the client acknowledges and agrees to all terms outlined in this Rental Agreement. Checking the acknowledgment box during checkout constitutes a binding digital signature.
