AZ Backyard Party Rentals - Rental Agreement

By booking with AZ Backyard Party Rentals (AZBPR), the client agrees to, understands, and accepts all of the following terms and conditions:


CUSTOMER PROFILE & ACCOUNT CREATION

All customers are encouraged to create an online account to streamline booking, payment tracking, and order management. The following information is required to complete a customer profile:

  • Full Legal Name
  • Valid Email Address

By creating an account, the customer agrees to maintain accurate, up-to-date information and acknowledges that their profile data will be used to manage all rentals, contracts, and communications. Profiles are protected under our data privacy and usage policy.


RENTAL ITEM CONDITION

AZBPR guarantees that all rental items are in good working order and without defects at the time of pickup or delivery. The client assumes full responsibility for returning all rental items in the same condition as when they were received.


WARNING & SAFETY LABELS

Clients and guests must read and adhere to all warning and/or safety labels available on rental items. These labels contain manufacturer-provided safety information for all users.


RENTAL PERIOD & LATE FEES

  • Standard rental period is 24 hours unless otherwise agreed upon.
  • If items are not returned or made available for pickup within 24 hours, the client will be charged an additional late fee of $50 per calendar day, regardless of usage. This fee continues to accrue until all items are returned.

DEPOSIT & PAYMENT TERMS

  • $50 refundable security deposit is required for all rentals and will be refunded if all items are returned in acceptable condition.
  • Full payment is due at checkout for all orders valued under $500.00.
  • For orders valued over $500.00, a 25% deposit is due to reserve the order. The remaining balance is due in full 10 days prior to the event date. It is at AZBPR’s discretion to offer a split payment option. This option is not available at checkout and must be arranged manually by contacting our team directly.
  • A $50 per day late fee may be in force if full payment is not received by the event date.
  • Accepted payment methods: All major credit & debit cards, PayPal, Amazon Pay, and Cash App Pay.

CANCELLATION & REFUNDS

  • Cancellations made more than 14 days before the event: Eligible for a refund, minus a 15% administrative fee.
  • Cancellations made 7–14 days before the event: Forfeit 25% of the total order amount.
  • Cancellations within 7 days of the event date: Forfeit 50% of the total order amount.
  • Orders placed within 7 days of the event date are non-refundable.
  • Weather-related cancellations are not eligible for refunds, but a non-transferable rental credit may be issued at the sole discretion of AZBPR, valid for up to 12 months.

DAMAGE, LOSS, OR CLEANING FEES

  • Lost, stolen, or irreparably damaged items will be charged at full retail replacement value, plus applicable tax and sourcing costs.
  • Dirty or excessively soiled items will result in a cleaning fee being deducted from the security deposit.

DELIVERY & PICKUP SERVICES

AZBPR offers convenient delivery and pickup services through our website, where you can select delivery preferences during checkout. Delivery options and availability are subject to staffing and logistics.

Delivery Details:

  • Minimum Order Requirement: $200 minimum order required for all deliveries.
  • Base Delivery Fee: $100 flat rate for deliveries within a 10-mile radius of our Chandler location.
  • Extended Range: Deliveries beyond 10 miles are charged $1 per additional mile, up to a maximum of 30 miles. Customers requiring delivery beyond 30 miles must contact us directly for approval.
  • Delivery Time Window:
    • Standard Delivery: Saturday between 10 AM – 5 PM.
    • Pickup: Scheduled for Sunday during the same 10 AM – 5 PM window.
    • Same-Day Delivery: Available on Saturdays upon request. Must be specified in the checkout comment box.
    • Friday Delivery (Evening): Available for orders over $500, between 5 PM – 7 PM.
    • Sunday Delivery: Not available unless Monday is a holiday.
  • Weekday Deliveries: Not available due to limited staff.
  • Additional Charges: Fees may apply for deliveries involving stairs, elevators, or extended carrying distances.
  • Booking Process: Delivery and setup services must be selected during checkout.
  • Clients must ensure delivery/pickup locations are paved, level, hazard-free, and easily accessible. Additional labor charges may apply if access is obstructed or unsafe.
  • Failure to meet these conditions may result in forfeiture of setup services without refund.

SETUP & TAKEDOWN SERVICES

We offer setup and takedown services for clients who need additional support preparing their event space. These services are optional and must be booked in advance.

  • Pricing: Services are billed at $60 per hour, with a 2-hour minimum per booking.
  • Custom Scheduling: Timing and availability are based on staff scheduling and event logistics.
  • Important Note: Setup and takedown services do not include cleaning of used rental items. All rented items must still be returned in clean condition to avoid cleaning fees.

PICKUP GUIDELINES & STORAGE SITE POLICY

By visiting AZBPR’s designated storage pickup location, the client agrees to the following terms:

  • Facility Conduct: The client must not damage the storage facility, disturb facility staff, litter, or leave any trash behind.
  • Proper Stacking: All rental items must be properly stacked and organized upon return, just as they were when picked up.
  • Order Integrity: Clients must only take their assigned rental items and must not take or tamper with other customers' orders within the unit.
  • No Abandoned Items: Clients must ensure they do not leave behind any items outside the storage unit. Any items left outside will be considered lost, and the client may be charged a fee for missing or misplaced items.
  • Monitoring & Security: The storage unit is monitored for security purposes. Tampering with, covering, or attempting to disable the camera inside the unit is strictly prohibited and will result in a breach of contract and potential legal action.

EQUIPMENT USAGE & RESTRICTIONS

  • Tables & Chairs: No standing, jumping, or improper use. Weight limits must be respected.
  • Tents: Once installed by AZBPR, tents must not be moved or adjusted by the client. Unauthorized movement may compromise safety and will result in additional fees.
  • Outdoor Games: All game pieces must be returned complete, undamaged, and placed back into their designated bags or containers. Items such as Giant Pong must be wiped down and dried if water or liquids were used during play. Failure to comply may result in additional cleaning or replacement fees.
  • Coolers: Outdoor coolers must be used responsibly and returned clean and free of debris. If coolers are returned with excessive dirt, residue, or standing water, a cleaning fee will be applied.

LINEN RENTALS

  • Pickup or Delivery: Linens are available for either pickup or delivery, depending on the order details.
  • Packaging: Linens will be provided on hangers or in containers; both must be returned in good condition.
  • Return Procedure: A mesh bag will be provided for soiled linens, which must be used to return the linens.
  • Cleaning Requirements: Linens must be returned free of food and debris but should not be washed by the client.
  • Color Recommendation: For events involving food service, we recommend selecting darker-colored linens to minimize the risk of visible stains.
  • Hanger Return: All provided hangers must be returned with the linens; a fee will apply for missing hangers.

HOLD HARMLESS & INDEMNITY

The client assumes all risks in the operation and use of any rental items. The client agrees to indemnify and hold harmless AZBPR from any claims, damages, or injuries resulting from misuse, unauthorized alterations, or improper handling of rental equipment.


FORCE MAJEURE

  • AZBPR is not liable for delays or cancellations due to events beyond our control (e.g., natural disasters, civil unrest, labor strikes).

DEFAULT & JUDICIAL ACTION

  • Failure to make payments or return items constitutes a breach of contract.
  • AZBPR reserves the right to pursue all available legal remedies, including judicial action, for contract violations.
  • Legal disputes will be resolved under the jurisdiction of AZBPR’s business location.

PHOTO & VIDEO USAGE

By booking with AZBPR, the client grants permission for AZBPR to capture, use, and publish event photos/videos for promotional purposes, unless a written request to opt-out is provided.


FINAL AGREEMENT

By placing an order with AZ Backyard Party Rentals, the client acknowledges and agrees to all the terms and conditions outlined in this rental agreement. This is a binding electronic agreement and no physical signature is required.

The client will be required to check a box during checkout to confirm acceptance of these terms.
